我向WHA抗議函內容曝光　對一中原則僅表達「關切」

有鑑於WHA寄送予我國的邀請函當中，附帶一中原則以及聯合國2758號決議文，對我國主權造成打壓及矮化，對此我國代表團於日內瓦時遞交抗議信，今日國民黨立委陳宜民質詢時詢問有關抗議信內容，外交部長李大維回覆，已經將信件內容送交外交國防委員會召委手中。

衛福部長林奏延遞交WHA秘書處之抗議信函內容：

With reference to letters and statements delivered by my predecessors in the last five years, I must reiterate Chinese Taipei's grave concern over the unresolved issue of the leaked WHO memo of September 2010 - "Application of the International Health Regulations (2005) to Taiwan, Province of China," and the misleading guidelines concerning the designation of Taiwan/Chinese Taipei in the WHO's intranet.

The Constitution of the WHO states: "The enjoyment of the highest attainable standard of health is one of the fundamental rights of every human being without distinction of race, religion, political belief, economic or social condition." Our participation, therefore, should be without the distinction of political belief as stated in the WHO Constitution. In this regard, we would like to register our concern over the mentioning of the one-China principle in your letter dated May 6, 2016, and the United Nations General Assembly Resolution 2758 (XXVI) and WHA Resolution 25.1 in your letters of May 6 and May 12 respectively, as we do not think it is necessary to do so.

參考過去五年所接受到的信件和聲明，我必須代表中華台北重申這些懸而未決的問題，並表示嚴重關切，過去WHO備忘錄中，2010年9月申請國際衛生條例（2005）所謂「台灣，中國的一省」（Taiwan, Province of China），誤導了台灣／中華台北，在世衛組織的認定。

世衛組織的章程規定：「健康達到最高標準的享受是每個人（不因種族，宗教，政治信仰，經濟或社會條件區分）基本權利之一。」因此，我們的參與應該沒有政治信仰的區別，在世界衛生組織章程規定。

在這方面，關於2016年5月6日你們邀請函當中，附帶的「一個中國原則」（one-China）部分，引起我們的關注，（以及聯合國2758決議和世界衛生大會25.1決議）我們不認為有必要這麼做。

對此國民黨立委陳宜民認為，這封信件僅短短兩段「沒頭沒尾」內容並不完整，而信件當中的措辭用語僅強調關切，距離「抗議」還很遙遠，因此感到十分失望。

民進黨立委羅致政稍晚也就議題質詢李大維，他指出目前公布的信件是不是抗議函的完整內容，並詢問這樣的用詞到底「有沒有表達抗議？」李大維回覆這並非完整內容，因為完整將內容公布並非良好的外交手段，同時他也表示，「以外交慣例來說，信函的措辭已經是在表達抗議。」

不過國民黨立委江啟臣拿出2010年邱文達部長署名的對WHA抗議信做出比較，當年的抗議函開頭便闡述「嚴正抗議」，江啟臣認為，當時措辭嚴厲的抗議函，並未造成我國後續參與WHA的困難，反觀今年林奏延部長的抗議函，根本不算抗議僅是關切。
